All this will do is increase the suicide rate in Scotland. What is needed is a law that makes creditors accept what people can realistically afford including a mandatory law where creditors must freeze all interest and charges. If a person has no property no assests savings etc what more can they actually do nothing all they are doing is wasting court time when a simple payment plan again of £1.00 a month dependent on the persons income is more useful than making people ill. What you will find is a lot of people becoming homeless to avoid or protect their families. I rent in the private sector BECAUSE there is no public sector housing available for me.<br />My rent has a considerable shortfall, and if I get evicted (as will probably happen if I can't get a job soon enough, especially given that I am on a Short Assured tenancy and the first six months has now finished. I don't even have the security of LA/Social housing tenures) then I'll be joining the ranks of the homeless and will be a further addition to the problem. But currently no-one is even listening to the plight of tenants in the private rental sector. I am not well off. I do not have a job. It took me months to find anyone willing to even offer me a tenancy. The current legislation re Landlord Registration, the deposit schemes and Gas checks etc is fine but at the end of the day you get desperate enough to waive your rights, and as for the deposit scheme: yes I could take report my landlord: certain outcome - eviction. APPEAL APPEAL APPEAL........Anonymousnoreply@blogger.comtag:blogger.com,1999:blog-2161487576630088909.post-75976211372782874662013-04-05T16:45:11.296+01:002013-04-05T16:45:11.296+01:00I am not surprised by the decision in this case – ...I am not surprised by the decision in this case – it seems pretty obvious to me that if there are two agreements in default, there should be default notices in respect of each agreement.<br /><br />In the case of Brandon v American Express, the English High Court, on appeal, held that while a defect in a default notice provided the debtor with a technical defence, the defect did not prejudice him and upheld the first instance decision to enter summary judgment for the creditor. <br /><br />The defect in question was that the default notice did not give the debtor the required 14 days to repay the arrears and this was held not to be prejudicial because he was in no position to repay the arrears even if he had been given more time.<br /><br />However, on a further appeal, the English Court of Appeal overturned the High Court decision. The reason for this was that the High Court had said that the debtor’s defence based on the defective default notice could not be dismissed as unreal and that it was realistically arguable that the failure of the default notice to give the debtor 14 days to repay the arrears could not be said to be de minimis or be ignored because it caused no prejudice [2011] EWCA Civ 1187.<br /><br />See also the English High Court case of Harrison v Link Financial Limited [2011] EWHC B3 (Mercantile) where, as in Brandon, a default notice did not give the debtor the required 14 days to pay the arrears. The Court held that:<br /><br />‘The notice of enforcement was a statutory pre-condition of enforcement. It was a bad notice and enforcement cannot be attempted in dependence upon it. However, bad notices can often be remedied by the service of good notices and I see no reason why that should not be so in respect of credit agreements.’<br /><br />Finally, there has been a recent English County Court case where a default notice understated the arrears owed by the debtor. I do not have a garden, garage or large shed all of which could be used to generate a modest income. As I do not have these amenities I feel that I should be exempt from the charge as I am receiving jobseekers allowance at the moment and cannot make any income from my spare room.. Also who came up with the amount of 14% for one bedroom as this is absurdly high. I ...I have just joined as a follower of this blog.<br /> I have a family member who suffers from a health condition and whom is going to be affected by the "bedroom tax".<br />I think it's a shameful tax and is going to be extremely stressful to people who suffer from anxiety, depression or any other mental health problem where people can't manage their own financial matters especially also as people are soon to be in control of managing their own money.
